Thomas <br /> Ratify Proposed Statement of Opposition <br /> This is an application seeking approval for expanded use of <br /> an existing water right by way of a Plan for Augmentation for a <br /> small domestic development near Buena Vista in Chaffee County. <br /> The current use is an in-house domestic well for 20 gpm to serve <br /> one single-family house and four cabins, with a priority date of <br /> August 23 , 1976. Additional residences have been constructed or <br /> are planned (a duplex and possibly another single-family home) , <br /> for which water service is needed. Besides in-house use, the <br /> applicant also requests approval for lawn and garden irrigation <br /> around all residences. Diversions will occur from Cottonwood <br /> Creek via both in existing well and a proposed new well; If all <br /> requested new uses are approved, additional depletions to <br /> Cottonwood Creek will total 0.5 acre-feet annually. The <br /> applicant proposes to make up such depletions from one share of <br /> Twin Lakes water purchased from the Southeastern Colorado WCD, <br /> which produces slightly over one acre-foot annually. <br /> The Board holds a decree for instream flow on Cottonwood <br /> Creek for 20 cfs. This appropriation carries a priority date of <br /> March 14, 1979. <br /> Because the proposed augmentation for this plan will not <br /> benefit Cottonwood Creek, but only downstream users on the <br /> Arkansas River, there is a theoretical injury to the Board' s <br /> instream flow claim on Cottonwood Creek. However, the amount of <br /> the depletion is so small that the magnitude of such injury is <br /> not measureable. <br /> Staff Recommendation <br /> The staff recommends that because of the extremely small <br /> amounts of water involved, a Statement of Opposition should not <br /> be filed in this case. <br /> JWM/gl <br /> 206 <br /> ai/18a <br />
