William McDonald, Director •44, �� Colorado Water Conservation Board `�'i'17/011 '9�F Department of Natural Resources 80�� 823 State Centennial Building 1313 Sherman Street Denver, CO 80203 Dear Mr. McDonald: Thank you for your letter of January 25 , 1984 , outlining your reasons for continuing to assert the belief that the project completed by the Henry Waneka Mutual Reservoir Company and the one studied under Contract #C153334 with the Water Conser- vation Board are the same project. We, however, maintain that the two projects are very different. We hope a closer look at the facts will clarify the apparent misunderstandings revolving around the projects . A summary of the significant elements is as follows : A. Basis for Projects 1. The. State Engineer's Office placed a volume restriction on the reservoir, May 23 , 1979 . It explained that this "hold order" would be enforced until the dam was brought up to minimum standards . The "hold order" referenced another letter of June 29 , 1978 , which outlined the specific improvements that had to be made , to bring Waneka up to minimum standard. 2. The WCB study of September, 1981 , was basically a report on the feasibility of enlarging Waneka Reservoir and that was its principal conclusion and recommendation. The data and standards specified (and required) by the SEC for Waneka were already existing 3 years prior to the WCB report. The WCB report only reiterated what was already common knowledge and very specific in instructions for minimum standards. 3 . If we wanted to utilize the full capacity of Waneka , then, we had to comply with the State Engineer' s orders . There was no room for negotiation.
