We, however, maintain that <br /> the two projects are very different. We hope a closer look at <br /> the facts will clarify the apparent misunderstandings revolving <br /> around the projects . A summary of the significant elements is <br /> as follows : <br /> A. Basis for Projects <br /> 1. The. State Engineer's Office placed a volume restriction <br /> on the reservoir, May 23 , 1979 . It explained that this <br /> "hold order" would be enforced until the dam was brought <br /> up to minimum standards . The "hold order" referenced <br /> another letter of June 29 , 1978 , which outlined the <br /> specific improvements that had to be made , to bring <br /> Waneka up to minimum standard. <br /> 2. The WCB study of September, 1981 , was basically a <br /> report on the feasibility of enlarging Waneka Reservoir <br /> and that was its principal conclusion and recommendation. <br /> The data and standards specified (and required) by the <br /> SEC for Waneka were already existing 3 years prior to <br /> the WCB report. The WCB report only reiterated what <br /> was already common knowledge and very specific in <br /> instructions for minimum standards. <br /> 3 . If we wanted to utilize the full capacity of Waneka , <br /> then, we had to comply with the State Engineer' s orders . <br /> There was no room for negotiation.
