Dear Mr. Ioannides:
As a - result of our recent meeting and a review of the contract
betcveen the Henry Waneka Mutual Reservoir Company (HWMRC) and
the Colorado Water Conservation Board (CWCB) , no justification
. was found for concluding that the project as contemplated in
said contract or in the final report entitled Engineering and
Feasibility Report for the Rehabilitation and Enlargement of
Waneka. Reservoir Dam as accepted by CWCB was constructed by
the Reservoir Company.
The foregoing position is based on several points as follow:
. the title of the report prepared by Water
Resources Consultants (WRC) indicates that the •
project contemplated was the rehabilitation and
enlargement of Waneka Reservoir dam;
. the recommendation of WRC which resulted from
the feasibility report was for the enlargement
of the dam;
. the rehabilitation of the dam completed by HWMRC
was based on engineering and feasibility work
done by an entirely different engineering firm,
Zorich and Associates;
. Section 5 of the CWCB/HWMRC contract states
". . .the Contractor shall pay to the State the
