• Fish and Wildlife Service opinions and that he had <br /> designated a team of Departmental staff members to work with <br /> the federal agencies in an effort to resolve this issue. <br /> At this point in the meeting Mr. McDonald recommended <br /> that the meeting be recessed for lunch and the Board would <br /> meet in executive session to discuss this issue and seek <br /> agreement on what position it should take. Mr. Woodard <br /> approved this recommendation. Thereupon Mr. Robbins moved, <br /> seconded by Mr. Johnston that the Board consider this item <br /> in executive session. Motion approved unanimously. <br /> The general meeting was recessed at 11: 30 a.m. and <br /> reconvened at 1 :15 p.m. <br /> Mr. McDonald remarked that during the executive ses- <br /> sion the members discussed the endangered fish species <br /> issue at some length and adopted a resolution which he <br /> presented to the audience. This resolution, moved by Mr. <br /> Robbins, seconded by Mr. Kroeger, reads as follows: <br /> The Board requests the Attorney General to take all <br /> steps necessary to prepare for potential litigation against <br /> the federal government in the event that a jeopardy opinion <br /> is rendered on any existing facility, including the Dolores <br /> and Dallas Creek Projects, which opinion calls for depletion <br /> • payments, minimum flow requirements, or any other require- <br /> ments which impair the rights of Colorado to its waters . <br /> Motion approved by unanimous voice vote. <br /> Agenda Item 5 - Attorney General 's Report <br /> Mr. Woodard stated that Mr. Jeff Kahn would report on <br /> several items after which he would briefly report on two issues, <br /> namely, potential litigation with Kansas on the Arkansas River <br /> Compact Operations, and the Riverside Lawsuit. <br /> Mr. Kahn summarized the following items : <br /> 1. Division 3 Rules and Regs decision <br /> (Alamosa-La Jara Water Users Protection Association <br /> v. Gould) <br /> a. Decided December 5, 1983 <br /> b. Purpose of Rules and Regs : <br /> (1) For administration of surface streams to meet <br /> compact obligations ; <br /> (2) To curtail well diversions unless they re- <br /> • place depletions to surface streams . <br /> -7- <br />
