DRAFT <br /> SUMMARY OF THE MAJOR PROVISIONS <br /> OF THE PROPOSED <br /> CONTRACT BETWEEN THE UNITED STATES OF AMERICA <br /> AND THE STATE OF COLORADO <br /> FOR REPAYMENT OF THE SEPARABLE COSTS FOR <br /> RECREATION AND FISH AND WILDLIFE <br /> ENHANCEMENT FACILITIES IN THE HEAD-SAN LUIS LAKES AREA, <br /> CLOSED BASIN DIVISION, SAN LUIS VALLEY PROJECT <br /> AND FOR THE OPERATION, MAINTENANCE, AND <br /> REPLACEMENT OF SUCH FACILITIES <br /> Facilities Leased to The State <br /> 1 . The United States in consideration of observance and <br /> performance by the State of its legal obligations under this <br /> contract , hereby leases to the State the recreation and fish and <br /> wildlife facilites as shown on exhibit "A," attached hereto. The <br /> State, at its own expense, hereby accepts the lease and the <br /> operation and maintenance responsibilities of the Leased <br /> Facilities as shown on exhibit "A" in accordance with the terms <br /> and conditions of this contract. <br /> Upon completion of construction of the recreation and fish and <br /> wildlife facilities or so much thereof as will permit substantial <br /> public use and upon 60 days written notice of such completion by <br /> the United States, the United States will transfer to the State <br /> and the State will assume administration and operation and <br /> maintenance responsibilities of the facilities thus far developed <br /> or provided. The State shall observe all Federal and State laws, <br /> rules, and regulations applicable to the Leased Facilities and <br /> shall keep the Leased Facilities in neat, orderly, safe, and <br /> sanitary conditions at all times. <br /> Terms of Contract <br /> 2. a. This Contract shall become effective on the date <br /> first hereinabove written and shall remain in effect for a period <br /> of 50 years from that date; Provided, That under terms and <br /> conditions mutually agreeable to the parties, renewals of this <br /> contract may be made for successive periods of not to exceed 50 <br /> years each. The terms and conditions of each renewal shall be <br /> agreed upon not later than 1 year prior to expiration of the then <br /> existing Lease Agreement. <br /> 119a <br /> con/sli <br />
