( 2) Any lands and water rights to be purchased by. the <br /> District for the project shall be appraised by an <br /> independent appraiser or appraisers of the Board 's <br /> choice and the amounts to be paid for such lands and <br /> water rights shall be subject to the Board 's prior <br /> approval; <br /> ( 3) The District shall, prior to commencing construction of <br /> the project, obtain such public access to the reservoir <br /> as the Board deems appropriate; and <br /> (4) Prior to commencing construction on the project, the <br /> District shall obtain from the owner(s) of any lands <br /> adjacent to the reservoir pool (at the maximum water <br /> surface elevation) the right to receive any appreciation <br /> in the value of the lands which is attributable to the <br /> construction and existence of the reservoir if and when <br /> those lands or any portion thereof are sold by the <br /> owner(s) . In turn, the District shall contract with the <br /> Board to convey to the Board any moneys which it might <br /> receive as a result of this requirement, said moneys to <br /> be in addition to the payments of $13,987,200 shown in <br /> Table 1 . <br /> III <br /> Compliance with Construction Fund Criteria <br /> Since the adoption of the criteria set forth in section <br /> 37-60-121 ( 1 ) (b) , CRS 1973, as amended, all actions taken by the <br /> -3- <br />
