Mr . Lochhead moved, seconded by Mr . Smith, that the Board • <br /> consider Items 11 and 12 in executive session. Motion adopted <br /> unanimously. <br /> Chairman Johnston recessed the general meeting at 11: 55 <br /> a.m. and immediately convened the executive session. <br /> Upon reconvening the general session, Chairman Johnston <br /> reported that the Board took no action on cases listed in Items <br /> 11 and 12. <br /> Agenda Item 13 - State Legislation (Appendix F) <br /> Mr . McDonald briefed the Board on the status of the <br /> following selected water bills being considered by the General <br /> Assembly: <br /> 1. House Bill 1042 - Annual construction fund bill . The <br /> amended bill was passed by the House and referred to the <br /> Senate. At Mr. McDonald ' s request the House version was amended <br /> in Senate committee, and as of the date of the Board meeting, <br /> the Bill was awaiting second reading in the Senate. Following <br /> Board discussion, Mr . Vandemoer moved, seconded by Mr . <br /> Lochhead, that the Board express its support for the Bill as <br /> amended and recommend to the House members to accept the Senate <br /> amendments, approve the Bill and submit it to the Governor . <br /> Motion adopted unanimously. <br /> 2 . House Bill 1070 - would create a new joint "capital <br /> development committee" parallel to the joint budget committee, <br /> which would set capital development and maintenance priorities . <br /> A provision concerning water would establish a fee of $50 per <br /> acre-foot for any water transported or diverted from the state. <br /> Such fees would be placed in a "water diversion fund" to be <br /> used for water projects . The bill has been referred to a <br /> conference committee. <br /> 3 . House Bill 1088 - would authorize the Colorado Water <br /> Resources and Power Development Authority to develop and <br /> construct three specified water projects, namely one on the <br /> Western Slope, one on the South Platte River above Denver and <br /> one on the South Platte River or its tributaries downstream of <br /> the Henderson gauging station. No action taken on bill to date. <br /> 4 . House Bill 1229 - would create a water development fund <br /> from a . 25% sales tax (reduced from . 40% by House Committee) . <br /> Status indefinite. <br /> 5 . Senate Bill 35 - would establish a loan fund in the <br /> Department of Local Affairs for municipal water or sewer <br /> systems from existing local government severance tax fund. <br /> 6 . Senate Bill 141 - would clarify • <br /> y procedures for judicial <br /> appointment of water conservancy district directors . <br /> -10- <br />
