Green Mountain Exchange (contract being negotiated) <br /> Agenda Item 8 - Policies and Strategies for Water Project <br /> Development (Appendix B attached) <br /> In reporting on this item, Mr. McDonald summarized the <br /> thoughts expressed in his March 7, 1985, memorandum to the Board, <br /> Strategies and Policies for Water Project Development in <br /> Colorado. He called attention to the many changes brought about <br /> in the 1970's and 80 's which alter the circumstances confronting <br /> the state in the development of its water resources . In view of <br /> these changes, water development in Colorado must face new <br /> realities, and state government must redefine its role in water <br /> development decisions and limitations thereon. <br /> Because of time constraints , Mr. McDonald was unable to <br /> complete the discussion paper as intended. Rather, the paper <br /> presented a brief outline of (1) circumstances facing water <br /> development in Colorado, (2) protection of interstate compacts, <br /> (3) policies, and (4) implementation activities . <br /> Following lengthy remarks by Board members and individuals <br /> in the audience, the Board directed the staff to consider the <br /> comments by Board members and to prepare a revised draft for <br /> further discussion at the May Board meeting. <br /> Agenda Item 9 - Endangered Species Act <br /> a. Whooping Crane (Appendix C attached) <br /> Mr. McDonald discussed this item and raised several areas <br /> of concern from the fourth draft of the "Platte River Joint <br /> Management Study. " These included: <br /> 1. The draft still confuses the issues of a recovery <br /> plan and the development of a reasonable and prudent alternative <br /> to the Narrows Unit where the state is somehow obligated to make <br /> the whooping crane better off. More specific language addressing <br /> the Narrow's limited role at this point in the process is needed. <br /> 2. A position that should be unacceptable to the Board <br /> is the assertion that sections 2 (c) (1) and 7 (a) (1) , together, <br /> place the Secretary of the Interior in the position of being able <br /> to use any Interior project (. --e )the Narrows Unit as a Reclama- <br /> tion project) to further the Endangered Species Act. <br /> 3. Perhaps there should be a reevaluation of the <br /> scientific basis for the critical habitat reach on the South Platte <br /> since sightings have been highly infrequent in recent years . <br /> -4- <br />
