Mr. Lochhead moved, seconded by Mr. Smith <br /> that the Board go into executive session. Motion adopted <br /> unanimously. <br /> Vice Chairman Robbins adjourned the general session at 4 :55 p.m. <br /> and announced that the executive session would follow immediately. <br /> (3) Case No. 4-84CW119 , Noel E. Andress - At the September 14 , 1984 , <br /> Board meeting, the Board ratified a statement of opposition <br /> • against this case, a proposed augmentation plan for a sub- <br /> division southeast of Crested Butte. In the interim, the staff <br /> met with the applicant' s engineer and prepared a proposed <br /> stipulation. (Stipulation is included in Appendix K. ) <br /> (4) Case No. 1-83CW327 , South Platte Greenway Foundation, Inc. - <br /> On March 15, 1985, the Board ratified a statement of opposi- <br /> tion in the above-referenced case on the grounds that the <br /> application for such a direct flow appropriation could be <br /> construed to constitute a minimum streamflow appropriation <br /> which only the Board has the authority to establish. <br /> A meeting was held last July to discuss the Board 's concerns <br /> with representatives of the Greenway Foundation. The <br /> Foundation assured the staff that it was not its intent to <br /> establish a minimum streamflow to preserve the natural environ- <br /> ment. Rather, it was making direct flow appropriations for <br /> the purposes of recreation and navigation. A stipulation was <br /> developed to clarify this point. (Stipulation is included in <br /> Appendix K. ) <br /> Vice Chairman Robbins reconvened the general session at 5 :40 p.m. <br /> Mr. McDonald reported that the Board, upon a motion by Mr. <br /> Furneaux, seconded by Mr. Lochhead, had unanimously approved the <br /> • <br /> -13- <br />
