Federal Reserved Water Rights Cases (Appendix F) <br /> Agenda Item 11 - Arkansas River Compact Issues (Appendix G) <br /> Mr. McDonald recommended that Agenda Items 10 and 11 be <br /> considered by the Board in executive session during the lunch <br /> hour. Attorney General Woodard advised that it was appropriate <br /> for these items to be taken up in executive session. <br /> Mr. Furneaux moved, seconded by Mr. Smith, that the two <br /> items be considered in executive session. Motion adopted <br /> unanimously. <br /> Vice Chairman Robbins recessed the general meeting at 12 : 30 p.m. <br /> and declared the executive session in order during the lunch break. <br /> Vice Chairman Robbins reconvened the general session at 2 :00 p.m. <br /> Mr. McDonald reported that during the executive session <br /> Assistant Attorney General Chris Hermann reviewed the litigation <br /> under way in the Sierra Club v. Block and the Indian Reserved <br /> Rights cases. Assistant Attorney General Paula Phillips reviewed <br /> the litigation involving other federal reserved water rights cases . <br /> No Board action was taken. <br /> Mr. McDonald reported that he and Mr. Will Bassett, Assistant <br /> Attorney General, had discussed Arkansas River Compact issues . <br /> Vice Chairman Robbins was not present for this discussion and <br /> Mr. McDonald had assumed the chair. <br /> Upon conclusion of Board discussion, Mr. McDonald reported <br /> that Mr. Furneaux had moved, seconded by Mr. Covert, that Mr. <br /> McDonald write a letter to the General Assembly leadership on <br /> behalf of the Board indicating the Board' s support for budget <br /> requests by the Attorney General and the State Engineer' s office <br /> for funding for the Arkansas River Compact issues . Mr. McDonald <br /> reported that this motion was adopted unanimously. <br /> Agenda Item 9 - Endangered Species Issues <br /> c. Reauthorization of the Endangered Species Act <br /> (Added Item, Appendix H) <br /> In his discussion of this item, Mr. McDonald stated that <br /> hearings on the reauthorization of the Endangered Species Act <br /> (ESA) are being held in the U. S. House on March 14 and suggested <br /> that the Board may want to adopt a statement supporting reauthori- <br /> zation and proposing some amendments to the Act.
