APPENDIX H
STATE OF COLORADO
COLORADO WATER CONSERVATION BOARD
Department of Natural Resources
823 State Centennial Building ,`,'•
1313 Sherman Street
Denver,Colorado 80203
Phone: (303)866-3441
Richard D.Lamm
M E M OR A N D U M Governor
J.William McDonald
Director
TO: - Members, CWCB David W.Walker
Deputy Director
FROM: Bill McDonald
DATE: February 9, 1984
SUBJECT: Agenda Item 11, February 16, 1984, Special Meeting--
Water Supply Determination for Navajo Reservoir
Long-term contracts for the sale of water from Navajo
Reservoir, New Mexico, cannot be made until the Secretary of
the Interior " . . . has determined by hydrologic investigation
that sufficient water to fulfill said contract is reasonably
likely to be available for use in . . . New Mexico during the
term thereof . . . " (section 11 (a) of P.L. 87-483) . Such
determinations must be submitted to and approved by Congress
• before contracts can be entered into.
One such determination was approved in 1968 and has served
as the basis for water service contracts extending to the year
2005. New Mexico has now requested a new determination so that
contracts can be extended to the year 2040 .
A draft of the requested hydrologic determination, dated
December 1983 (copy enclosed) , has been circulated by the Bureau
of Reclamation for comment. At a January meeting of the Engi-
neering and Legal Committees of the Upper Colorado River Commis-
sion, the four states agreed to review the draft determination
and seek to develop a Commission position at a meeting scheduled
for March 20 .
The Board needs to review this matter now so that Colorado
can provide its comments, via Felix Sparks and me, to the Commis-
sion staff. At the Board ' s mid-March meeting, we can review the
Commission staff' s proposed Commission position.
In addition to the draft hydrologic determination, I have
enclosed:
900A
Memo (BMcD)
APPENDIX H
Herbert H.Vandemoer,Chairman-Richard W.Johnston,Jr.,Vice Chairman
C.M.Furneaux,Floyd L.Getz,Robert A.Jackson,Frederick V.Kroeger,James S.Lochhead,David W.Robbins,David H.Smith
