<br /> 3 "SECTION 9. 37-60-119, Colorado Revised Statutes, as
<br /> 4 amended, is amendiu to read:

<br /> 6 37-60-119. Construction of water and power facilities -
<br /> 7 contracts with and charges against users. (1) In order to
<br /> 8 promote the general welfare and safety of the citizens of this
<br /> 9 state, the board may construct, rehabilitate, enlarge, or
<br /> 10 improve, OR LOAN MONEYS TO ENABLE THE CONSTRUCTION,
<br /> 11 REHABILITATION, ENLARGEMENT, OR IMPROVEMENT OF, such flood
<br /> 12 control , water supply, and hydroelectric energy facilities,
<br /> 13 together with related recreational facilities, in whole or in
<br /> 14 part, as will , in the opinion of the board, abate floods or
<br /> 15 conserve, effect more efficient use of, develop, or protect
<br /> 16 the water and hydroelectric energy resources and supplies of
<br /> 17 the state of Colorado. In carrying out such program, the
<br /> 18 board is directed to place special emphasis upon the adoption
<br /> 19 and incorporation of measures which will encourage the
<br /> 20 conservation and more efficient use of water, including the
<br /> 21 installation of water meters or such other measuring and
<br /> 22 control devices as the board deems appropriate in each
<br /> 23 particular case.

<br /> 25 (2) The board may enter into contracts for the use of,
<br /> 26 OR TO LOAN MONEYS TO ENABLE THE CONSTRUCTION, REHABILITATION,
<br /> 27 ENLARGEMENT, OR IMPROVEMENT OF, said flood control , water,
<br /> 28 power, and any related recreational facilities, by-aR9 with
<br /> 29 any agency or political subdivision of this state or the
<br /> 30 federal government, with individuals, with corporations, or
<br /> •
<br /> 31 with organizations composed of citizens of this state. Any
<br /> 32 such contracts may provide for such charges to the using
<br /> 33 entity as, in the opinion of the board, are necessary and
<br /> 34 reasonable to recover the board's capital investment, together
<br /> 35 with operational , maintenance, and sery}ee INTEREST charges
<br /> 36 over the term of years agreed upon by contract. Seri4ee
<br /> 37 INTEREST charges shall be assessed at no less than five
<br /> 38 percent. Any such charges so collected shall be credited to
<br /> 39 and made a part of the Colorado water conservation board
<br /> 40 construction fund. All or any portion of the costs
<br /> 41 attributable to flood control and recreation may be considered
<br /> 42 nonreimbursable in the discretion of the board, but only to
<br /> 42
<br /> the extent approved by the general assembly as specified in
<br /> 44 section 37-60-122.

<br /> 46 SECTION 10. 37-60-120, Colorado Revised Statutes, is
<br /> 47 amended to read:

<br /> 49 37-60-120. Control of projects - contractual powers of
<br /> 50 board. The state of Colorado shall have the ownership and
<br /> 51 control of such portions of said projects, OR SHALL TAKE A
<br /> 52 SUFFICIENT SECURITY INTEREST IN PROPERTY OR TAKE SUCH BONDS,
<br /> 53 NOTES, OR OTHER SECURITIES EVIDENCING AN OBLIGATION, as will
<br /> 54 assure repayment of funds made available by section 37-60-119.
<br /> 55 The board is empowered to enter into contracts which are, in
<br /> 56 its opinion, necessary for the maintenance and continued
