There was considerable discussion on this item by Board <br /> • members and individuals in the audience. Several Board members <br /> were very displeased with Mr. Buterbaugh' s response to Mr. <br /> Getches' letter. Mr. Frank Dunkle, staff member from the U. S. <br /> Fish and Wildlife Service, attempted to rebut these comments by <br /> assuring the Board that his agency would seek administrative <br /> solution and that Mr. Buterbaugh's letter was not intended to <br /> indicate otherwise. <br /> Following this discussion, Mr. McDonald summarized the <br /> Board's deliberations and recommendations as follows : <br /> (1) The Board desires an administrative solution. <br /> (2) The Board will not press for a legislative solution <br /> in 1984. Legislative relief will be sought in 1985 if satisfac- <br /> tory results are not achieved through administrative efforts. <br /> (3) The staff, as part of the Department of Natural <br /> Resources' efforts, will participate in an analysis to be under- <br /> taken to resolve this issue. <br /> (4) The staff, with all interested parties, including <br /> both environmental interests and water-user groups, will seek an <br /> administrative solution. <br /> • (5) Mr. McDonald will work with other Upper Basin states, <br /> the Fish and Wildlife Service, and the BR in the resolution of this <br /> problem. <br /> (6) The only litigation to be pursued at this time is the <br /> already pending appeal of the Riverside case. <br /> Mr. Johnson moved, seconded by Mr. Robbins, that the Board <br /> adopt the six points listed above. The motion was approved by <br /> unanimous voice vote. (The six recommendations are described more <br /> fully in Mr. McDonald's February 17, 1984, memo to the Board-- <br /> Colorado River Endangered Fish Species, attached as Appendix J.) <br /> b. Whooping crane <br /> Mr. McDonald briefly discussed his suggested draft response <br /> to the proposal for a "Plani1. of` Action" from the BR and the Fish <br /> and Wildlife Service, discussed at the November 1983 Board meeting <br /> (Appendix J attached) . <br /> Before Board action on the draft, Mr. McDonald suggested <br /> minor word changes in the letter to be forwarded to the BR and the <br /> Fish and Wildlife Service. Mr. Jackson moved, seconded by Mr. <br /> Getches, that the letter be forwarded with the suggested changes. <br /> The motion was adopted by unanimous voice vote. <br /> • <br /> -11- <br />
