Reconsideration of Previous Request to Negotiate for
the Purchase of Ruedi Reservoir
Introduction
At its May, 1980, meeting, the Board decided to ask to
enter into negotiations with the Bureau of Reclamation to obtain
the right to market the regulatory capacity of Ruedi Reservoir.
The memorandum which I provided to the Board at that time is
attached for your background information.
Formal negotiations with the Bureau of Reclamation have
never been commenced. The primary reason is that the Bureau
proceeded with the first round of individual water service
contracts from Ruedi rather than first negotiate the sale of the
entire regulatory capacity to a single entity. Those contracts
have now been consummated and each of them contains a clause, at
the request of the Colorado River Water Conservation District and
me that such contracts would be assignable should a third party,
such as the River District or the Water Conservation Board,
subsequently obtain the right to market the entire regulatory
capacity of Ruedi Reservoir.
With the first round contracts now completed, the River
District has renewed its request to negotiate for the entire
regulatory capacity. In turn, the Bureau has inquired of me as
to whether the Water Conservation Board is itself still
