It was also the consensus <br /> of the members that the request to the Attorney General for <br /> • <br /> clarification of the statutory language be withdrawn. <br /> Agenda Item 12 - Approval of Stage 3, Closed Basin Project <br /> Chairman Vandemoer called on Mr. McDonald to discuss this <br /> item. In his remarks, Mr. McDonald called the members attention <br /> to his October 24, 1983 memorandum which provided the background <br /> for required Board action prior to initiation of construction of <br /> Stage 3 of the Closed Basin Project. (See Appendix G attached. ) <br /> Following discussion, Mr. Lindell H. Elfrink, construction <br /> engineer for the project, presented a report on the status of <br /> construction activities underway on the project. Of special <br /> significance mentioned in his report, Mr. Elfrink, indicated that <br /> 58 salvage wells in Stage 1-2 have been installed. Work is <br /> underway on the laterals in Stage 1-2 and on the conveyance <br /> channel in this reach of the project. With construction funds <br /> appropriated as programmed, the first project water can be <br /> delivered to the Rio Grande in the fall of 1985. <br /> There being no further discussion, Mr. Getz moved, seconded <br /> by Mr. Smiht, that the Board approve the resolution giving the <br /> Board's consent to the preparation of designs and specifications <br /> and to the construction of the conveyance channel and laterals in <br /> Stage 3 so long as: (1) the project proceeds in substantial <br /> • conformity with the Definite Plan Report for said project, (2) <br /> the U.S . Bureau of Reclamation proceeds with diligence in the <br /> construction of of Stages 1-2 and 3 of the project, (3 ) <br /> construction of such conveyance channel and laterals is in <br /> compliance with applicable state law and (4) the Colorado Water <br /> Conservation Board is not, by this action, giving its consent to <br /> the U.S . Bureau of Reclamation to start construction on Stages 4 <br /> and 5 of the project, except those features necessary for <br /> pre-construction activities, such as testing and preparation of <br /> design data, or to start production pumping of Stage 3 wells. <br /> The motion was approved by unanimous voice vote. (See <br /> Appendix G. ) <br /> Following this action, Mr. McDonald announced that since the <br /> lunch hour was approaching, he suggested that Agenda Item 15 be <br /> taken up at that time and Agenda Items 13 and 14 be deferred <br /> until after lunch. <br /> Agenda Item 15 - Amendments to Clean Air Act <br /> In the discussion of this item, Mr. McDonald summarized the <br /> legislation now before Congress for reauthorization of the Clean <br /> Water Act and amendments being considered to the Act in the House <br /> and Senate. These proposed amendments were summarized in his <br /> September 6, 1983 memorandum to the Board which were reviewed at <br /> the September 8-9, 1983 Board meeting.
