Following discussion on Case No. 1-80CW379 (South Boulder <br /> Creek) , Mr. Getz moved seconded by Mr. Grant, that the <br /> stipulation be ratified with paragraph 14 deleted with a proviso <br /> and that the environmental interests be so advised but if these <br /> interests file a statment of opposition, the instream flow <br /> appreciation delineated in the Case would be dropped. The motion <br /> was adopted by unanimous vote. <br /> Director Floyd Getz left the meeting at this point in the <br /> proceedings. <br /> Discussion then proceeded on Case No. 82CW104 , (Town of <br /> Poncha Springs) which called for ratification of the stipulation <br /> relevant to an application for water rights by the Town. During <br /> the discussion of this item, Mr. Paddock recommended that further <br /> consideration should be given to this case and he therefore <br /> recommended that the Board not ratify the stipulation. Mr. <br /> Johnston moved, seconded by Mr. Kroeger, that the Board not <br /> approve the ratification and instruct the Attorney General to <br /> proceed as deemed preferable. The motion was approved by <br /> unanimous voice vote. <br /> Following this action, Chairman Fetcher announced that the <br /> executive session was concluded and the public session was <br /> reconvened. Mr. McDonald reported the actions taken at the <br /> executive session as indicated above. <br /> Mr. Jencsok discussed Case No. 82-CW-052 , Findings and <br /> Ruling of Referee concerning the application of the Town of Erie <br /> for Water Rights in Boulder and Weld Counties. The Board, <br /> together with several other entities, had previously filed <br /> Statements of Opposition to this Application. Based upon <br /> subsequent discussions between the Referee and opposing parties, <br /> all Statements of Opposition were withdrawn and the Referee <br /> granted the application contingent upon the Board ' s approval in <br /> the May 5 , 1983 meeting. Mr. Jackson moved, seconded by Mr. <br /> Furneaux that the Board approve the decree. The motion was <br /> adopted unanimously by voice vote. <br /> Mr. Jencsok discussed Case No. 4-82CW038, Riverland Joint <br /> Venture and presented the staff recommendation which provided for <br /> Board authorization to withdraw the Statement of Opposition <br /> previously filed. Mr. Kroeger moved, seconded by Mr. Grant, that <br /> the staff recommendation be approved. The motion was adopted <br /> unanimously by voice vote (see Appendix Fd ) . <br /> Case No. 2-82CW138 , Grape Creek from Deweese Reservoir to <br /> Deweese-Dye Ditch Headgate was brought before the Board. This <br /> case involved a ratification of change in a water right <br /> application filed previously by the Board. The staff recommended <br /> that the Board authorize the withdrawal of the above-referenced <br /> filing on Grape Creek and notify all interested parties of this <br /> action.
