Case No. 82CW104
Water Division No. 2
Findings, etc .
Page 5
as much of it as is feasible up to 27 acre-feet per year to
storage in Boss Lake , North Fork Reservoir or O' Haver Lake
in the headwaters of the South Fork of the Arkansas River.
An equivalent amount of water to that stored in the reservoirs
will be left in the Arkansas River to replace the stored
water when necessary in the time of a valid call to protect
diverters on the Arkansas River downstream of its confluence
with the South Fork of the Arkansas River. The approximately
27 acre-feet of storage each year , together with carry-over
storage from prior years will be generally sufficient to
replace irrigation season depletions described in parograph 7
above while accounting for transit losses and evaporation and
seepage losses from the reservoirs . When there is a valid
senior call from the South Fork of the Arkansas River during
the irrigation season , releases from the upstream reservoirs
will be made as necessary to replace depletions by the Poncha
Springs wells . This replacement water will also prevent harm
to diverters on the Arkansas River downstream of the Salida
sewage treatment plant.
Since the applicant will obtain its water supply
from the South Fork alluvium and its domestic return flows
will be directed to the Arkansas River through the Salida
sewage treatment plant, the depletion to the South Fork of
the Arkansas River will be equal to the total amount of
water pumped by the applicant minus return flows from
irrigation and is estimated to be a maximum of 0 .07 cfs.
for a population of 500 . In order to prevent injury to
senior South Fork Arkansas diverters during the irrigation
season , the applicant has obtained a lease option for 0 .07
cfs . of the Harrington Ditch from the City of Salida under
which Salida will forego diversions of that amount of its
ownership in the ditch. Since the Harrington Ditch is the
senior ditch on the South Fork below Poncha Springs , this
agreement will protect all other diverters on the South Fork
of the Arkansas River.
9 . Depletions to the Arkansas River resulting
from diversion and use of water by the applicant consist of
the amount actually consumed in-house and that portion of
water used for irrigation of grass and landscaping which is
lost to the atmosphere via evapotranspiration . Whenever
there is a call for water on the South Fork of the Arkansas
River, depletions will be replaced by releases of stored
water from Boss Lake, North Fork Reservoir or O'Haver Lake.
