DISTRICT _COURT, WATER DIVISION NO. 2 , STATE OF COLORADO <br /> Case No. 82CW104 <br /> STIPULATION <br /> IN THE MATTER OF THE APPLICATION <br /> FOR WATER RIGHTS OF THE TOWN OF <br /> PONCHA SPRINGS <br /> IN CHAFFEE COUNTY <br /> COMES NOW the Town of Poncha Springs , applicant <br /> herein, by its attorneys , Moses, Wittemyer, Harrison and <br /> Woodruff, P.C. , and the Colorado Water Conservation Board , <br /> objector, by and through the Attorney General of Colorado, <br /> and stipulate as follows : <br /> 1. In consideration for protective conditions <br /> contained in the proposed Findings of Fact, Conclusions of <br /> Law and Decree in this matter, a copy of which is attached <br /> hereto and incorporated by reference herein as Exhibit A, <br /> the Colorado Water Conservation Board does approve said <br /> decree and withdraw its statement of opposition subject to <br /> the remaining condition that this stipulation is subsequently <br /> approved and ratified by formal action of the Colorado Water <br /> Conservation Board. <br /> 2 . It is agreed by the parties that if the <br /> Colorado Water Conservation Board should not formally <br /> approve and ratify this stipulation, that it shall move <br /> under the retained jurisdiction of the Court as provided <br /> in said decree for such further relief as it shall assert <br /> to be required. <br /> DONE this 13A...day of March, 1983 . <br /> MOSES , WITTEMYER, HARRISON AND <br /> WOODRUFF, P.C. <br /> By <br /> David L.
