STIPULATION
IN THE MATTER OF THE APPLICATION
FOR WATER RIGHTS OF THE TOWN OF
PONCHA SPRINGS
IN CHAFFEE COUNTY
COMES NOW the Town of Poncha Springs , applicant
herein, by its attorneys , Moses, Wittemyer, Harrison and
Woodruff, P.C. , and the Colorado Water Conservation Board ,
objector, by and through the Attorney General of Colorado,
and stipulate as follows :
1. In consideration for protective conditions
contained in the proposed Findings of Fact, Conclusions of
Law and Decree in this matter, a copy of which is attached
hereto and incorporated by reference herein as Exhibit A,
the Colorado Water Conservation Board does approve said
decree and withdraw its statement of opposition subject to
the remaining condition that this stipulation is subsequently
approved and ratified by formal action of the Colorado Water
Conservation Board.
2 . It is agreed by the parties that if the
Colorado Water Conservation Board should not formally
approve and ratify this stipulation, that it shall move
under the retained jurisdiction of the Court as provided
in said decree for such further relief as it shall assert
to be required.
