HUPP: I have examined the local situation rather <br /> carefully as to the manner of operation of the Frontier Z <br /> Ditch. It now diverts water entirely from Colorado into <br /> n <br /> Kansas by intercepting the flow of Holly drain and of <br /> Wild Horse Creek at a point a few hundred feet down stream <br /> from where such water crosses under the Banta Fe railroad <br /> bridge across Cheyenne Creek. <br /> Beyond that, I do not know what additional statement <br /> the commission might want from me. <br /> CHAIRMAN KRAMER: The point for consideration at our <br /> last meeting, as I recall without taking the time to look <br /> up the exact reference, was that there was some question <br /> as to the Frontier Ditch presently having a contract or <br /> being engaged in some form or other in the purchase of <br /> water from somebody in Colorado, and that there was some <br /> assertion that that water so purchased and obtained was <br /> in a sense not subject to the provisions of this Compact. <br /> It seems to me that was the point to be clarified. <br /> MR. KNAPP: Mr. Leavitt has obtained some information <br /> on that. I don' t believe he has been able to see the contract. <br /> MR. LEAVITT: There is nothing I can add to that except <br /> that we have not been able to secure copies of the present <br />
