Arn: It is ay general impression from study <br /> of other compacts and from pretty authoritative comments <br /> on the operation of compacts, that it is generally un- <br /> desirable to give the administrative body under a compact <br /> Judicial or even quasi-Judicial powers. I think we are <br /> violating that principle in this instance. <br /> Let me pall attention to the fact that in our consid- <br /> eration of Article IV-P, where this very situation is also <br /> a matter at issue, and covers the construction of works, <br /> we very carefully steered away from saying who will make <br /> that determination in the final analysis, and I think <br /> wisely so. Probably it will have to be legally deter- <br /> mined by a court of competent Jurisdiction, and pre- <br /> sumably such a court will consider if not rely upon the <br /> advice of the administrative body under this Compact. <br /> The question here of transfer of rights is similar <br /> in character but of somewhat more limited front, and it <br /> seems to me we ought to find some formula for handling <br />
