CANAL COMPANY <br /> (as amended and restated February 26, 1979) <br /> FIRST, The corporate name of this Mutual Ditch <br /> Company shall be THE UPPER PLATTE AND BEAVER CANAL <br /> COMPANY. <br /> SECOND, Said Company was originally incorporated on <br /> May 26, 1888, by Jarad L. Brush, Daniel Hawks , and <br /> James Max Clark. <br /> THIRD, The objects and purposes for which said <br /> Company is formed and incorporated , are , and shall <br /> be : <br /> 1st. To acquire by proper conveyances, all the rights , <br /> title , interest, privileges , appropriations of water , rights of <br /> way, powers and franchises, which The Platte and Beaver <br /> Improvement Company has or had , in , to, over and concerning <br /> that certain irrigating canal , known and called , the Upper or <br /> Main Ditch of The Platte and Beaver Improvement Company, now <br /> situated in the County of Morgan ( formerly Weld) in the State <br /> of Colorado, the same being an irrigating ditch constructed in <br /> the year 1882 by said The Platte and Beaver Improvement <br /> Company, also all head-gates, waste-gates , flumes, sand-chutes, <br /> bridges, dams, dikes, lateral and branch ditches, in any way <br /> connected with or appurtenant to said irrigating canal . <br /> 2nd . To operate , construct, superintend , maintain and <br /> keep in repair said ditch or canal , with its branches and <br /> -2- <br />
