In <br /> conducting this evaluation I have considered the Final Recreational In-Channel Diversion(RICD) Rules <br /> adopted by the Colorado Water Conservation Board-(CWCB) on November 15, 2005. This letter <br /> specifically addresses Section 7 (C) of the Rules: <br /> Whether there is access for recreational in-channel use. <br /> I have been working with David Smith, City" Attorney, on issues relating to access to the boating park for <br /> which the City of Durango is seeking an RICD. <br /> Access to the boating park is taken from US 550/160 at Santa Rita Drive in Durango. The property from <br /> the highway to the boating park is owned by the City of Durango. <br /> The City of Durango is owner of property on the east bank and to the middle of the river on the lower end <br /> of the boating park and the entire river including both banks on the upper end of the park. The west bank <br /> of the lower end of the park belongs to Santa Rita Properties, LLC. I have written to Santa Rita <br /> Properties describing the boating park plans and I have explained our desire to construct facilities in the <br /> river on property that they own. I have not received a reply to my request to obtain an easement for <br /> construction and maintenance of the boating park features: - • <br /> • <br /> • <br /> • <br /> • <br /> • <br /> r <br />
