At present, the major uses upstream of the Boating Park include <br />irrigated agriculture, hydroelectric power generation at the Tacoma station, the City of <br />Durango municipal intake, and the Animas Water Company. As evidenced by such <br />uses, there are numerous suitable upstream points of diversion or storage which may be <br />used by those who would place the water to consumptive beneficial use. <br />Absolute Water Rights <br />Review of the water rights tabulation for Water District 30 indicates that there are <br />approximately 1,050 cfs of absolute direct flow water rights and 33,900 acre -feet of <br />absolute storage water rights in the Animas River basin upstream of the Boating Park <br />location. <br />Conditional Water Rights <br />There are also approximately 120 cfs of conditional direct flow water rights and <br />approximately 24,300 acre -feet of conditional storage water rights that can be used to <br />support future upstream development. These water rights would be senior to the City's <br />Boating Park water right. <br />Existing Undecreed Uses <br />There are presently undecreed diversions upstream of the City of Durango. <br />According to the District 30 Water Commissioner, the amount of undecreed diversions is <br />highly variable and difficult to quantify. <br />Pending and Future Water Rights Applications <br />When decreed, water rights filed for in Water Court prior to 2006, but not yet <br />decreed, will be senior to the City's RICD claim. To assess the recent water rights <br />applications, we reviewed the Division 7 Water Resume for the past two years. During <br />2004 and 2005, claims for approximately 10 cfs of absolute direct flow water rights and <br />approximately 120 acre -feet of absolute storage water rights were filed with the Water <br />Court. Conditional appropriations totaled approximately 30 cfs of direct flow water rights <br />and approximately 190 acre -feet of storage rights. All of the pending water rights claims <br />are located above the City's Boating Park. <br />7 <br />
