Exhibit A to Stipulation and Agreement between Chaffee County and the Colorado Water Conservation Board DISTRICT COURT, WATER DIVISION NO. 2, DRAFT DECREE: 7/2/13 COLORADO, STATE OF COLORADO Pueblo County Judicial Building 320 West 10th Street Pueblo, CO 81003 A COURT USE ONLY A CONCERNING THE APPLICATION OF CHAFFEE Case Number: 12CW107 COUNTY (04CW129) IN CHAFFEE COUNTY, COLORADO Water Division: 2 FINDINGS OF FACT, CONCLUSIONS OF LAW,RULING OF THE REFEREE AND DECREE OF THE WATER COURT The Application in this Case was filed on October 30,2012("Application")and was referred to the Water Referee for Water Division 2, State of Colorado,by the Water Judge of this Court in accordance with C.R.S. 37-92-101, et. seq.,known as the Water Right Determination and Administration Act of 1969. The undersigned Referee having made such investigations as are necessary to determine whether or not statements in the application are true, and having been fully advised on the subject matter of the application,does hereby make the following determination and Ruling as the Referee in this matter: FINDINGS OF FACT 1. Names and Address of Applicant: Chaffee County("County") do Don Reimer, Chaffee County Engineer 104 Crestone Ave Salida,CO 81201 2. Opposition. Statements of Opposition were filed by the City of Salida and the Colorado Water Conservation Board. The City of Salida thereafter withdrew its Statement of Opposition. The time for filing such statements of opposition has expired. A Stipulation was entered into between the County and the Colorado Water Conservation Board that was approved by Order of the Referee and the form of this Ruling and Decree is consistent therewith. 3. Report of the Division Engineer. A Consultation Report was filed by the Division Engineer in this case on March 6,2013, stating no objection to the claims. This Court has given due consideration to the Division Engineer's Consultation Report.
