My testimony concerned the historic use, consumption attributable to <br /> new uses, and terms and conditions to prevent injury through the change of water <br /> right and augmentation of junior out-of-priority diversion. My deposition was taken <br /> in April 2003, and the case settled prior to trial. <br /> • 00CW259 —In the Matter of Water Rights Application for the Eagle River Water& <br /> Sanitation District—Application for new conditional rights for in-channel use for <br /> recreational boating and fishery uses in a whitewater park on Gore Creek within the <br /> Town of Vail. My testimony concerned reasonableness and waste, whether a <br /> diversion has occurred and if the applicant captured possessed or controlled the water, <br /> and whether the proposed appropriation was a beneficial use. The application was <br /> filed in 2000. My deposition was taken in April 2002, and trial testimony in May <br /> 2002. <br /> • 00CW281 —In the Matter of Water Rights Application for the Town of Breckenridge— <br /> Application for new conditional rights for in-channel use for recreational boating and <br /> fishery uses in a whitewater park on the Blue River at the Breckenridge Recreational <br /> Center.
