You should be aware that this office can not authorize <br /> any work until a 401 water certification from the State of Colorado is issued. <br /> You should submit an application to the State of Colorado, if you have not <br /> already done so. <br /> e. Purpose and Need <br /> According to permit application, "the overall project purpose is to improve <br /> recreational and functional habitat characteristics by: (1) the re-construction of <br /> several failed fish habitat structures into functioning, stable, in-stream <br /> structures; (2) stabilizing and revegetating stream banks; (3) enhancing aquatic <br /> habitat characteristic through the reach." <br /> The permit application does not describe the extent to which the previously <br /> authorized (DA # 199375014) fish habitat structures are not functioning. <br /> General condition 2 of permit number 199375014 states that "you must <br /> maintain the activity authorized by this permit in good condition and in <br /> conformance with the terms and conditions of this permit. You are not <br /> relieved of this requirement if you abandon the permitted activity." If the <br /> structures were failing due to the lack of general long-term maintenance, then <br /> you are technically in violation of your permit conditions. <br /> The permit application does not describe the existing conditions of the bank or <br /> the need for stabilization. In addition, you have not provided a stabilization or <br /> revegetation plan. Please supply this information. <br /> The permit application does not describe the existing aquatic habitat condition, <br /> the need to enhance the aquatic habitat, and a description and plan as to how <br /> the aquatic habitat will be enhanced. Please supply this information. <br /> f. Endangered Species Act and Historic Properties <br /> Your permit application does not address affects your project may have on <br /> Federally-listed threatened or endangered species, or cultural resources. <br /> Please supply this information. <br /> g, Mitigation <br /> After you have adequately identified all expected impacts associated with the <br /> construction of your project, please submit a compensatory mitigation and <br /> monitoring plan. <br /> h. USGS stream gauge <br /> The impact to the US Geological Survey (USGS) gaging station number <br /> 09342500 is a violation of the terms and conditions of permit number <br /> 199375014. As a result of your work, you re-established a new gaging station <br />
