Subject: Memorandum of Agreement (MOA) for Furnishing Water from Ruedi Reservoir for
Endangered Fishes -Fryingpan-Arkansas Project, Colorado
Dear Mr. Evans:
We have reviewed the Colorado Water Conservation Board's (CWCB) proposed revisions to the
subject MOA, approved at the July 1998, CWCB meeting. The MOA also incorporates revisions
• : discussed between Randy Seaholm(CWCB) and Julie Swanda(Reclamation) and between you,
Randy Seaholm, Henry Maddux of the Fish and Wildlife Service, Brent Uilenberg of
Reclamation's Western Colorado Area Office and Alice Johns. Minor changes were made
throughout the agreement. Article 1. reflects additional definitions, and Article 4. incorporates
additional language to cover reimbursement of the O&M costs by the Recovery Program.
Consistent with standard provisions for Round II water contracts, the Recovery Program will pay
the full cost of operation and maintenance on 21,650 acre-feet covered by the 1998 MOA.
If the revised MOA is acceptable, please have the three revised originals signed on behalf of the
CWCB and then Federal Express these three originals to the U. S. Fish and Wildlife Service
(Service). By copy of this memorandum the Service is asked to sign the three originals of the
MOA and return them to this office, by Federal Express, for signature by the Bureau of
Reclamation(Reclamation). After signature by Reclamation, we will return one fully executed
original of the MOA to each party.
Reclamation proposed revisions to the U.S. Fish and Wildlife Service's 1995 Biological Opinion
for the Round II Water Marketing Program, and understands that the CWCB was in agreement
with these revisions. (See enclosed memorandum of June 3, 1998, for a copy of this proposal.)
The Service is drafting an amendment to the 1995 opinion. Upon receipt of the draft
Amendment, Reclamation will provide a copy to CWCB and other parties for review. The review
III period will be limited to two weeks, after which Reclamation will submit any comments to the
Service.
