1 23 14 <br /> Page 11 of 19 <br /> c. Costs. Upon receipt of treated water from LDWA that meets the treatment <br /> standards of Paragraph 10.a.,LPWWA shall pay the following costs: <br /> i. Treatment Facility. LPWWA shall pay its pro-rata share of the <br /> actual operation, maintenance, and repair costs(OM&R),both fixed <br /> and variable, of LDWA's treatment facility. For fixed costs, <br /> LPWWA's pro-rata share shall be based on capacity of LDWA's <br /> system. For variable costs, LPWWA's pro-rata costs shall be based <br /> on use within LDWA's system and shall include water losses. <br /> ii. Water. LPWWA shall pay LDWA for the amount of water actually <br /> delivered to its Points of Delivery that meets the treatment <br /> standards of Paragraph 10.a., plus its pro-rata share of the amount <br /> of water lost in the treatment and delivery said water. LPWWA <br /> shall install a meter at its point of delivery and LDWA will have a <br /> meter at the Water Treatment Plant. These meters will be used to <br /> determine LPWWA's share of the quantity of water lost in delivery, <br /> subject to the following. The loss calculations shall be determined <br /> by the Rate Committee 110.d.), unless the Parties agree otherwise. <br /> In no instance shall the loss percentage exceed 15% of the amount <br /> of water actually delivered. <br /> iii. Reservoir Storage. LPWWA shall pay its pro-rata share of the <br /> actual operations and maintenance costs, both fixed and variable, of <br /> Lake Durango Reservoir. For fixed costs, LPWWA's pro-rata share <br /> shall be based on capacity of LDWA's system. For variable costs, <br /> LPWWA's pro-rata share shall be based on use within LDWA's <br /> system. <br /> iv. Replacement Reserve Fund. <br /> 1. The Rate Committee identified in Paragraph 10.d. shall consult <br /> with a professional to estimate the replacement cost of LDWA's <br /> treatment facility and of that portion of LDWA's distribution <br /> system used to deliver treated water to LPWWA. The Rate <br /> Committee shall use the replacement costs of said capital <br /> improvement to identify the amount of money necessary for a <br /> reserve fund. <br /> 2. Treatment Facility. At least annually, LPWWA and LDWA shall <br /> contribute to a reserve fund for the replacement of LDWA's <br />
