1 23 14 <br /> Page 4 of 19 <br /> b. Ownership. LPWWA, the SUIT, and the UMUT shall own the 210 <br /> Pipeline. Their ownership interests are as follows: <br /> LPWWA 20.6% <br /> SUIT 52.9 % <br /> UMUT 26.5% <br /> c. System Capacity. The 210 Pipeline has an estimated capacity of 25 c.f s, of <br /> which 20.6% (approximately 5 c.f.s.) is available to LPWWA. LPWWA <br /> grants LDWA a right to use 400 g.p.m. (0.89 c.f.s) of LPWWA's capacity <br /> in the Water Conveyance System. LPWWA reserves its right to use its <br /> remaining capacity in the Water Conveyance System, which is <br /> approximately 4.11 c.fs. With the prior written consent and approval of <br /> LPWWA, LDWA shall be entitled to use 800 g.p.m. of LPWWA's <br /> capacity in the 210 Pipeline for the delivery of water to both LDWA and <br /> LPWWA. In the event that the obligations contained in Paragraph 10 are <br /> terminated, LDWA shall be limited to using 400 g.p.m. of LPWWA's <br /> capacity in the 210 Pipeline, unless the Parties agree otherwise in writing. <br /> d. Use. LPWWA and LDWA shall use the 210 Pipeline for the conveyance <br /> of water for municipal or domestic purposes, which includes commercial <br /> uses, and those purposes that further municipal or domestic uses of water, <br /> which may include augmentation or replacement of diversions, provided <br /> that any resulting new use of water is for municipal or domestic purposes, <br /> which includes commercial use. There are no restrictions on the use of <br /> water carried in the 210 Pipeline by the UMUT or SUIT. <br /> e. Design and Construction. LPWWA, the SUIT, and the UMUT will jointly <br /> agree on a scope of work for the design of the 210 Pipeline and will jointly <br /> select engineering and construction firms to provide services for the 210 <br /> Pipeline. LPWWA shall consult with LDWA prior to agreeing to a final <br /> design for the 210 Pipeline and will not agree to a final design that is <br /> incapable of delivering 800 g.p.m. to Lake Durango. LPWWA will use its <br /> best efforts to advocate for design alternatives that provide economic and <br /> efficient water delivery to Lake Durango when LDWA is the only entity <br /> using the 210 Pipeline. <br /> f. Working Group. LPWWA and LDWA shall each designate two <br /> representatives to form a working group tasked with evaluating the design <br />
