U.S. GRANT ADMINISTRATION STANDARDS — JANUARY 2006 <br />North American Wetlands Conservation Act and Neotropical Migratory Bird Conservation Act <br />Appendix A <br />Certifications and Assurances <br />Through acceptance of the Assistance Award, in addition to the assurances appended to Standard Form 424, <br />the Recipient's Authorized Representative certifies to the best of his or her knowledge and belief that: <br />A. Certification Regarding Proposal Submission The Assistance Award is for the support and stimulation <br />of the recipient's project; that the request for financial assistance and the related proposal have not <br />been submitted in response to a request from the Government to undertake work to support a specific <br />Government project; and that the proposal has been prepared without the assistance and/or input of <br />Federal personnel. However, this statement excludes the general technical assistance provided by <br />FWS staff to all applicants and grantees as needed or requested. <br />B. Certification Re ag rding Conflict of Interest There are no relevant facts or circumstances which could <br />give rise to an individual or organizational conflict of interest. Such conflict of interest could involve <br />such things as Government employees being associated with or being a member of the requesting <br />organization and being in a position to influence the awarding of a Grant Agreement. The Recipient <br />agrees that if an actual or potential conflict of interest is discovered, the Recipient shall make a full <br />disclosure in writing to the Service Program Officer. This disclosure shall include a description of <br />actions, which the Recipient has taken or proposes to take, after consultation with the Service Program <br />Officer, to avoid, mitigate or neutralize the actual or potential conflict. <br />C. Certification Regarding Debarment Suspension and Other Responsibility Matters (13I2010 June 1995) <br />(1) The prospective primary participant certifies to the best of its knowledge and belief, that it, its <br />principals and lower tier participants: <br />(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or <br />voluntarily excluded by any Federal department or agency; <br />(b) Have not within a three -year period preceding this proposal been convicted of or had a civil <br />judgment rendered against them for commission of fraud or a criminal offense in connection with <br />obtaining, attempting to obtain, or performing a public (Federal, State or local) transaction or contract <br />under a public transaction; violation of Federal or State antitrust statutes or commission of <br />embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, <br />or receiving stolen property; <br />(c) Are not presently indicted for or otherwise criminally or civilly charged by a government <br />entity (Federal, State or local) with commission of any of the offenses enumerated in paragraph (1)(b) <br />of this certification; and <br />(d) Have not within a three -year period preceding this application /proposal had one or more <br />public transactions (Federal, State or local) terminated for cause or default. <br />(2) Where the prospective primary or lower tier participant is unable to certify to any of the statements <br />in this certification, such prospective participant(s) shall attach an explanation to this proposal and <br />send it to the FWS Program Officer. <br />D. Certification Regarding Lobbying (DI2010 June 1995) [applicable if award exceeds $100,000] <br />(1) No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, <br />to any person for influencing or attempting to influence an officer or employee of an agency, a <br />Member of Congress, and officer or employee of Congress, of an employee of a Member of Congress <br />25 <br />
