Ownership of Storage Rights. The Storage Rights are all associated with the Durango Mountain Resorts ski area. The Storage Rights were originally obtained by entities or individual associated with the ski resort and, by various conveyances, were conveyed to the T -H Land Company who, in turn, conveyed the water rights to DMLC by deed dated October 25, 2002. 4. Cooperation with CWCB to Facilitate Abandonment. As a condition of certain land use approvals, DMLC agreed to work with the CWCB to protect the Hermosa Creek drainage and riparian environment by relinquishing its control of the Storage Rights. The CWCB has collaborated with DMLC in this process and helped facilitate the abandonment set forth herein. As a result, 1,351 acre -feet of Storage Rights senior to the CWCB's in- stream flow right on the East Fork of Hermosa Creek are hereby retired. A letter from the CWCB in support of this filing is attached hereto. 5. Reservation of other Conditional Water Rights. The abandonment expressed herein pertains only to the Storage Rights expressly identified above and not to any other water rights owned by DMLC. Dated this 10 'h day of September, 2003. aaoz65 -3-
