13.0 Conclusions and Recommendations <br /> The above information was prepared as a draft report in January, 1995 and was the basis for <br /> authorization of a loan from the CWCB for $2,250,000 towards a total project cost of$3,000,000 <br /> to enlarge the Red Mesa Reservoir from 1180 acre-feet to 4080 acre-feet. <br /> In the spring of 1996, following a very dry winter, the Company attempted to divert its winter <br /> water rights to fill Red Mesa Reservoir. The diversion was only made for a few days until legal <br /> action by the other water rights curtailed any further diversions. With the inability to divert <br /> winter water, implementation of the plan described herein has stopped. <br /> However, since 1996 the various water users in the LaPlata River basin have been attempting to <br /> develop a plan whereby the benefits of the enlargement would be expanded to include the entire <br /> basin. A conceptual plan is described in the June, 2000 report titled "Western LaPlata County <br /> Water Management and Conservation Plan". The water users continue to make progress towards <br /> a plan to benefit the entire basin but no agreement has been reached. <br /> The plan described herein will not be implemented because it is not feasible due the inability to <br /> divert water under the Company's water rights during the winter. Therefore, the Company <br /> requests that the $2,250,000 loan, which was based on the information in this report, be <br /> deauthorized and the feasibility study loan forgiven according to the provisions of the loan. <br /> 32 <br />
