The permanent Commission shall be comprised of four (4) tap owners, one (1) to be <br /> elected from each precinct, and one (1) at-large member to be elected by all four (4) <br /> precincts. The duration of the term of each member of the Company's Commission shall <br /> be five (5) years, except for the first such election in which the Commissioners shall <br /> serve staggered terms as provided in these Rules and Regulations. <br /> [Provisions for staggering terms] <br /> 1.5 PURPOSE. The purpose of these Rules and Regulations is to ensure the orderly and <br /> uniform control, administration and operation of the water treatment, distribution and <br /> management systems of the Company. <br /> 1.6 POLICY. The Rules and Regulations serve a public use and are necessary to ensure and <br /> protect the health, safety, property, security and general welfare of the customers of the <br /> Company. <br /> 1.7 SCOPE. These Rules and Regulations shall govern the operations of the Company. <br /> 1.8 INTENT OF CONSTRUCTION. It is intended that these Rules and Regulations be <br /> liberally construed to effect the general purposes of the Company. Each part of the Rules <br /> and Regulations is separate and distinct from all the other parts. No omission or <br /> additional material in these Rules and Regulations is an alteration, or waiver of, or <br /> deviation from any grant, power, duty, responsibility, limitation, or restriction imposed or <br /> conferred upon the Commission by statutes now existing or subsequently amended, or by <br /> any contract or agreement existing between the Company and any other governmental <br /> entity. Nothing in these Rules and Regulations shall be construed to prejudice or affect <br /> the right of the Company to secure the full protection of any law that is now enacted or <br /> may be subsequently enacted. <br /> 1.9 AMENDMENTS. The Company retains the power to amend these Rules and <br /> Regulations to reflect those changes determined to be necessary by the Commission. The <br /> Company is not required to provide prior notice of amendments. Amendments to these <br /> Rules and Regulations may be accomplished by explicit modification or by the adoption <br /> of policies or decisions by the Commission at its meetings, in which event such <br /> amendments shall be evidenced by reference to the adoption of policies or decisions in <br /> the minutes of the meetings of the Commission. <br /> 2.0 VARIANCES. The Commission reserves the right to grant variances to these Rules and <br /> Regulations when in its judgement the variance would be in the interest of fairness to the <br /> customer or the interest of good business practice by the Company. <br /> The Commission has the sole authority to waive, suspend, or modify these rules except <br /> where a duty, responsibility, limitation, or restriction has imposed or conferred upon the <br /> Company by statutes now existing or subsequently amended, or by any contract or <br /> agreement existing between the Company and any other governmental entity. Any <br /> waiver, suspension, modification or variance must be in writing, signed by the <br /> Commission. Any such waiver is not an amendment of the Rules. <br /> 2 <br />
