Item No. 4 of the Amended Stipulation and Item 8.b. of the original Stipulation <br /> requires bi-monthly reports be submitted to the Division Engineer on progress made toward <br /> fulfilling each step of the plan. The Stipulation outlines certain permitting and engineering and <br /> financing activities necessary to increase the storage capacity of Bull Creek Reservoirs Nos. 1, <br /> 2 and 4 to allow for storage of the full decreed amount of the subject water rights. <br /> This report actually covers September through December 2005. As you are already aware, a <br /> meeting was held at the SEO's Grand Junction office on Sept. 1, 2005. The outcome of that <br /> meeting was an agreement between all parties to re-structure and extend the Stipulation, and <br /> perform a preliminary or cursory assessment of the entirety of the Bull Creek Reservoirs (Nos. <br /> 1-5, inclusive) by early summer 2006. Specific dates and a more detailed scope of work were <br /> to be included in the revised Stipulation. <br /> To this end Bull Creek Reservoir Company President Iry Johnson forwarded a revised <br /> Stipulation and Agreement to John Sikora in October; and surveying work was performed on <br /> Bull Creek No. 5 to determine potential adequacy of a natural overflow for possible use as an <br /> emergency spillway. <br /> It has come to my attention that the September 1, 2005 meeting did not obviate submittal of <br /> the "bi-monthly reports."
