Alte.
WATER RESOURCE CONSULTANTS, LLC
January 30, 2006 Via e-mail
Alan C. Martellaro, P.E.
Division 5 Engineer
Water Division 5
POB 396
Glenwood Springs, CO 81602
Attn: Amy Stengel
Natural Resources& Environment Section
1525 Sherman, 5th Floor
Denver, CO 80203
RE: Construction File No. C-1877
Status Report per Amended Stipulation and Agreement between:
The State, Division Engineer and Bull Creek Reservoir Canal and Power Company;
Case No. 01CW337 and Consolidated Case Nos. 02CW158 and 02CW159, Bull Creek
Reservoir Nos. 1,2 and 4, Water Division 5, Water District 72, Mesa County
Dear Mr. Martellaro and Ms. Stengel,
This letter provides a status report in compliance with the above Amended Stipulation and
Agreement. Item No. 4 of the Amended Stipulation and Item 8.b. of the original Stipulation
requires bi-monthly reports be submitted to the Division Engineer on progress made toward
fulfilling each step of the plan. The Stipulation outlines certain permitting and engineering and
financing activities necessary to increase the storage capacity of Bull Creek Reservoirs Nos. 1,
2 and 4 to allow for storage of the full decreed amount of the subject water rights.
This report actually covers September through December 2005. As you are already aware, a
meeting was held at the SEO's Grand Junction office on Sept. 1, 2005. The outcome of that
meeting was an agreement between all parties to re-structure and extend the Stipulation, and
perform a preliminary or cursory assessment of the entirety of the Bull Creek Reservoirs (Nos.
1-5, inclusive) by early summer 2006. Specific dates and a more detailed scope of work were
to be included in the revised Stipulation.
To this end Bull Creek Reservoir Company President Iry Johnson forwarded a revised
Stipulation and Agreement to John Sikora in October; and surveying work was performed on
Bull Creek No. 5 to determine potential adequacy of a natural overflow for possible use as an
emergency spillway.
It has come to my attention that the September 1, 2005 meeting did not obviate submittal of
the "bi-monthly reports." Therefore, by virtue of this report, we are resuming short bi-monthly
status reports.
244 Hutton Ave., Rifle, CO 81650 PH/Fax(970)625-5433 pcurrier @bwn.net
