Waters of the U.S. includes ephemeral, internlittent <br />and perennial st�-eams, their surface connected �vetlands and adjacent wetlands and certain lalces, ponds, <br />drainage ditches and irrigation ditches that have a nexus to interstate commerce. <br />This tetter is to inform you that the proposed worlc is the type of aciivity thai is included in the <br />Section 404{� exemption found at 33 C.F.R. Part 323.4{a) {3) consfiruction and maintenance of farm or <br />stocic ponds or irrigation ditches and assoczated stnichires and the mainienance of, but not the <br />consiruction of drainage ditches; or (6) consi��iction or maintenance af farm roads. <br />Although a Department of the Army permit wi11 no# be required for this activity, this does not <br />eliminate the requirements that other applicable federal, state, iribal, and local permits are obtained if <br />needed. <br />If there are any questions call lYlr.
