PARTIES <br /> This Grant Agreement(hereinafter called"Grant") is entered into by and between City of Lamar, 103 North <br /> Second Street,Lamar,Colorado, 81052,a home rule municipality,acting by and through its Water Enterprise <br /> (hereinafter called"Grantee"),and the STATE OF COLORADO acting by and through the Department of <br /> Natural Resources,Colorado Water Conservation Board(hereinafter called the"State or CWCB"). <br /> 2. EFFECTIVE DATE AND NOTICE OF NONLIABILITY. <br /> This Grant shall not be effective or enforceable until it is approved and signed by the Colorado State Controller <br /> or designee(hereinafter called the"Effective Date").The State shall not be liable to pay or reimburse Grantee <br /> for any performance hereunder, including,but not limited to costs or expenses incurred,or be bound by any <br /> provision hereof prior to the Effective Date. <br /> 3.RECITALS <br /> A. Authority,Appropriation,And Approval <br /> Authority for the agency entering into this Contract arises from Colorado Revised Statutes(CRS)39-29- <br /> 109(2)(c),37-75-104(2)(c)and 37-75-102 et al.,and Senate Bill 06-179 adopted by the 2006 General <br /> Assembly,and a sufficient unencumbered balance thereof remains available for payment.Required <br /> approvals, clearance and coordination have been accomplished from and with appropriate agencies. <br /> Page I of 16 <br />
