r✓' <br />• <br />• <br />• <br />Colorado Water Conservation Board <br />Concerning the Application for Water Rights <br />of the Town of Avon <br />in Eagle County, Colorado <br />PREHEARING ORDER <br />Case Number: <br />05CW258 <br />A prehearing conference in this proceeding was held at 10:00 a.m. on October 13, 2006, <br />at 1313 Sherman, Room 721, Denver, Colorado, before the Hearing Coordinator, Casey <br />Shpall. The purpose the prehearing conference was to resolve procedural issues prior to <br />the hearing and to establish an agenda for the hearing before the Colorado Water <br />Conservation Board (Board), scheduled for November 15. 2006, at 10:00 a.m. at the Red <br />Lion Hotel, 4040 Quebec Street, Denver, Colorado. <br />In attendance at the prehearing conference, either in person or by phone, were the <br />following: <br />.yt <br />1 <br />Gary Greer and Doran Matzke for the Town pf Avon; Beth Ann Parsons for Colorado <br />Springs Utilities; Peter Fleming for the Colorado River Water Conservation District; John <br />Dingess for the City of Aurora; Lori Satterfield for the Town of Minturn; Scott Grossup <br />for Country Club of the Rockies and Ted Kowalski and Susan Schneider for the Board <br />Staff <br />1. Pending Motions <br />Rebuttal Statements are due October 20, 2006. <br />There are no pending motions. Any motions must be received by the Board, the Parties <br />and Staff by October 23, 2006, and any responses are due by October 27, 2006. <br />2. Hearing Issues <br />a) Whether the adjudication and administration of the recreational in- channel <br />diversion (RICD) would impair the ability of Colorado to fully develop and place <br />to consumptive beneficial use its compact entitlements; <br />b) Whether the RICD is for an appropriate reach of stream required for the <br />intended use; <br />
