Ruling and Decree <br />Case No 980-^410 <br />Page 5 <br />Notes: <br />1. None of the Priorily No. 1 water is owned by Home Supply. Such water was transferred into the Home Simply Ditch <br />by private owners in various court proceedings decreed in 1903,1913,1914, and 1928. These water rights have been <br />diverted and used under the Home Supply system for municipal or agricultural purposes, depending on then- ownership. <br />These rights have been included in Applicant's ditch-wide analysis, but are not submitted for change of water rights in <br />this proceeding. <br />2. The BTDMC priorities (2,4,10 and 20) set forth in Table 1 above total 56 cubic feet per second and represent <br />18.664583 of the total 48 shares outstanding in the BTDMC. These water rights were transferred into the Home <br />Supply Ditch in three separate proceedings in the District Court in and for Boulder County, to wit: Case No. 4061, by <br />decree dated April 6, 1903; Case No. 6831, by decree dated March 13,1914; and Case No. 8795, by decree dated <br />August 5,1928. They have been diverted and used under the Home Supply system since those times and they have <br />been included in Applicant's ditch-wide analysis of the Home Supply system, together with the other water rights listed <br />in Table 2, below. <br />3. The 1903 decree in Case No. 4061 included 46 cubic feet per second of priorities 2,4,10 and 20. Said decree <br />limited the diversion season for said water rights to a period fiom the start of the direct flow irrigation season until July <br />14 at noon each year. Historically, this condition has been strictly administered by the Water Commissioner. <br />4. Home Supply owns 8.075 of the 18.664583 shares of BTDMC carried in Home Supply. The water derived fiom these <br />shares is delivered pro rata to the Home Supply shareholders. This water owned by Home Supply, together with all the <br />other BTDMC water included in Case No. 98CW410, was transferred in the 1903 decree cited in footnote 3 above and <br />this is subject to the seasonal limitation described diere. <br />5.
