Water Rights
Wadley Farms No. 3 Water Rights
Wadley Farms No. 3 Subdivision obtains water for its water system from three FHL
shares that are owned by the HOA and from water yielded under the Wadley Reservoir
water storage rights. In the past, the HOA has leased from 0.5 to 1.0 additional shares of
FHL Company. (Information on FHL developed by the State Engineer's Office and
Colorado Water Conservation Board is included in Appendix C.)
FHL Company owns water rights ranging from very senior to relatively junior as shown
in Table 1. The company has 12 direct flow water rights on Clear Creek that total 733.61
cfs, most of which also allow for storage of the water. These rights were originally
decreed for irrigation use. The most senior rights, with appropriation dates of 1863 and
earlier, are likely to be in priority for all or most of the irrigation season in most years and
total 48.717 cubic feet per second (cfs). The more junior water rights for diversion from
Clear Creek have appropriation dates ranging from 1865 to 1895. These rights may only
be in priority during the spring and early summer and may yield little water in very dry
years. The water right with priority date of April 1, 1872 is for 154 cfs and is typically in
priority through the high runoff period until late June or early July. When the 1872 right
is in priority, the FHL can take 206.75 cfs. FHL Company also holds direct flow rights
for tributary streams crossed by the canal (Ralston Creek, Little Dry Creek and Leyden
Creek) and for small reservoirs owned by the company.
Table 1: Water Rights - Farmers' High Line Canal
Rank
Source
Appropriation Date
Adjudication Date
Decreed Amt tcfs
Uses
1
Clear Ck
2/25/1860
10/4/1884
0.276
Direct Flow
3
Clear Ck
5/16/1860
10/4/1884
1.0
Storage & Direct
5
Clear Ck
5/31/1860
10/4/1884
3.281
Storage & Direct
9
Clear Ck
7/1/1860
10/4/1884
39.8
Storage & Direct
30
Clear Ck
5/28/1863
10/4/1884
1.61
Storage & Direct
32
Clear Ck
6/20/1863
10/4/1884
2.75
Storage & Direct
42
Clear Ck
4/23/1865
10/4/1884
2.89
Storage & Direct
48
Clear Ck
11/2/1865
10/4/1884
0.808
Direct Flow
54
Clear Ck
5/24/1870
10/4/1884
0.33
Storage & Direct
57
Clear Ck
4/1/1872
10/4/1884
154.0
Storage & Direct
68
Clear Ck
4/1/1886
10/9/1895
191.0
Storage & Direct
69
Clear Ck
4/23/1895
10/9/1895
335.86
Storage & Direct
--
Little Dry Ck 4/1/1872
5/12/1936
186.04
Direct Flow
--
Ralston Ck
4/1/1872
5/13/1936
127 53.515
Direct Flow
--
Leyden Ck
7/12/1905
5/13/1936
434.925
Direct Flow
Source: Colorado Water Rights Tabulation, Colorado State Engineer's Office, Dept. of Natural Resources
The majority of water from the FHL is now delivered to municipalities.
