<br />7 | Page <br />CWCB Feasibility Study – County Road 52 Improvements & Grading <br />(CLOMR) and the Physical Letter of Map Revision (PMR) to FEMA in order to expedite the review and <br />approval of FEMA floodplain mapping revisions. Although the post project floodplain mapping has not <br />been completed as yet, Exhibit E provides a general idea of the floodplain reduction that will occur after <br />the construction of ESDF, LWCCS, opening the I-25 box culverts and the Prospect Road bridge <br />improvements at Boxelder Creek. <br /> <br />Project Sponsor <br />General <br /> <br />The Authority was established as a drainage authority pursuant to C.R.S. § 29-1-204.2 (2). The Authority <br />is operated as an enterprise within the guidelines of TABOR and the Water Activity Enterprise Law, Part <br />1 of Article 45.1, Title 37, C.R.S. As such, The Authority collects Service and Syste m Development Fees <br />annually from the unincorporated area of Larimer County, and the portions of Fort Collins and <br />Wellington that lie within the Service Area. <br /> <br />The Authority is governed by a Board of Directors consisting of five (5) members (the “Directors”), <br />consisting of one each selected by the City of Fort Collins, the Town of Wellington and Larimer County, <br />and two unaffiliated members, representing the public at large, one selected by the City of Fort Collins <br />and Larimer County upon mutual agreement and one by the Town of Wellington and Larimer County <br />upon mutual agreement. The Authority has the power to condemn property for public use and has the <br />authority to enter into contractual agreements. <br /> <br />The Original IGA and the By-Laws for the Authority as well as a map of the Service Area are included in <br />Appendix. <br />Service Area <br /> <br />The current Service Area includes over 56 square miles within the tributary area of Boxelder Creek within <br />Larimer County (Exhibit F). The current service area stretches from County Road 70 to the confluence of <br />Boxelder Creek and the Cache La Poudre River approximately one mile south of the Prospect Road / <br />Interstate 25 Interchange. It encompasses all of the Town of Wellington and portions of Larimer County <br />and the City of Fort Collins. This includes 5600 residences and 292 commercial and industrial properties. <br />Alternative Analysis <br /> <br />The proposed improvements to County Road 52 and related work came out of Larimer County’s concerns <br />about roadway overtopping on county roads between the original regional detention site referred to as <br />Edson Reservoir and the present location of ESDF (reference the CWCB Feasibility Study for ESDF). <br />Their concerns were centered on the fact that ESDF is four miles further south than the Edson site and <br />therefore the overtopping of several county road crossings would no longer be benefited by the more <br />southern site. At the same time it was recognized that ESDF provided the added benefit of a larger <br />detention volume resulting is substantially lower flows in the Boxelder Creek basin below ESDF. There
