deliver water for purposes other than those related to agriculture as defined herein, and if an
<br /> agreement is not reached for additional consideration, Grantor may terminate Easement at the end
<br /> of the initial term, or any time thereafter with 180 days written notice to Grantee, their successors
<br /> or assigns. The Easement is located on, over and through Grantor's Property, and is specifically
<br /> described as a strip of land thirty(30) feet in width, centered on the Water Pipeline, and described
<br /> as follows:
<br /> A strip of land 30 feet in width as shown on the map attached as Exhibit A, in the S1/2 of
<br /> Section 18, Township 4 North, Range 59 West of the 6th P.M., Morgan County,
<br /> Colorado.
<br /> At any time within six (6) months after installation of the Water Pipeline, and completion
<br /> of as-built drawings, the Easement may be surveyed at the request of either party, at the
<br /> requesting party's cost, and the parties agree to execute correction documents as may be required
<br /> to grant a thirty (30) foot easement centered on the Water Pipeline, and to record the same as an
<br /> amendment to this Agreement. Thereafter, the easement as corrected shall be the Easement for
<br /> purposes of this Agreement and any amendments thereto.
<br /> The Easement is granted over, above, upon, across, in and through Grantor's Property.
<br /> This grant of easement shall run with the land for the benefit of the Grantee, its successors and
<br /> assigns.
<br /> 2. Use of Easement By Grantee. With prior notification or approval of Grantor,
<br /> Grantee's agents, employees, contractors and other designated persons may go upon the
<br /> Easement at all reasonable times to undertake routine use, operation, and maintenance of the
<br /> Water Pipeline and associated facilities located on, over, in or above the Easement.
<br /> In the event Grantee plans major repairs or replacement of infrastructure within the
<br /> Easement premises, it shall provide Grantor with reasonable advance notice of the work to be
<br /> undertaken, and the estimated time of completion. Notwithstanding the foregoing, Grantee may
<br /> go upon the Grantor's Property at any time in the event of an emergency situation or condition,
<br /> and undertake such repair or replacement activities as it deems necessary to properly resolve the
<br /> emergency situation.
<br /> After the exercise of any of its rights hereunder, Grantee shall grade, re-seed or re-sod if
<br /> necessary to restore the surface of the ground to its former condition and contour, provided
<br /> however, that the Grantee shall not be required to restore or replace any trees, bushes, brush,
<br /> gardens, or other vegetation on the Easement, nor any structures or paving thereon.
<br /> 3. Use of Easement by Grantor. Grantor shall retain the right to use and enjoy the
<br /> Grantor's Property including the Easement so long as such use and enjoyment do not interfere
<br /> with the Grantee's rights hereunder, and provided that Grantor shall not install or allow any
<br /> obstructions or permanent encroachments on, in or over the Easement, including but not limited
