<br /> AN ORDINANCE ESTABLISHING THE TOWN OF FOWLER WA'
<br /> ENTERPRISE PURSUANT TO C.R.S. §37-34.1-101 ET SEQ.
<br /> WHEREAS,the town of Fowler("District") is a state of Colorado municipal corporation
<br /> founded in 1901; and
<br /> WHEREAS, District is a local government entity that has authority to conduct water
<br /> activities created pursuant to title 32, C.R.S.; and
<br /> WHEREAS, District is the sole owner and operator of the town of Fowler potable and
<br /> non-potable water system which provides a secure water supply for domestic use; and
<br /> WHEREAS,the District adopted Ordinance No. 522 on or about July 8, 1997 which
<br /> established a Water Enterprise in conformance with the Colo. Const. Art X, Sec. 20; and
<br /> WHEREAS,the District has its own bonding authority under C.R.S. §31-21-102; and
<br /> WHEREAS,pursuant to C.R.S. § 37-45.1-103 the District has the legal capacity to
<br /> establish and maintain a water activity enterprise to pursue or continue water activities, including
<br /> water acquisition or water project or facility activities, including the construction, operation,
<br /> repair, and replacement of water facilities.
<br /> NOW,THEREFORE, BE IT ORDAINED, BY THE BOARD OF TRUSTEES OF
<br /> THE TOWN OF FOWLER, COLORADO, AS FOLLOWS.
<br /> a. The Town of Fowler Water Activity Enterprise is hereby established pursuant to C.R.S.
<br /> §37-45.1-103(1).
<br /> b. Water Activity Enterprise Purpose. The purpose of the water activity enterprise is to pursue
<br /> and continue water activities, including, but not limited to water diversion, storage,
<br /> carriage, delivery, distribution, collection, treatment, use, reuse, augmentation, exchange, or
<br /> discharge of water,the provision of wholesale or retail water,the acquisition of water or
<br /> water rights, and water project or facility activities, including the construction, operation,
<br /> repair, and replacement of water facilities including, but not limited to, dams, storage
<br /> reservoirs, compensatory or replacement reservoirs, canals, conduits,pipelines, tunnels,
<br /> power plants, water treatment facilities and any and all works, facilities, improvements and
<br /> property necessary or convenient for the purpose of conducting a water activity.
<br /> c. Governing Body. The governing body of the water activity enterprise shall be the
<br /> governing body of the District. Whenever,the governing body of the District is in session,
<br /> the governing body of the water activity enterprise shall be in session without the need to
<br /> give separate notice or to distinguish between the acts of the governing body of the District
<br /> and acts of the governing body of the water activity enterprise.
