The easement area encompasses 46.27 acres. <br />Signatory parties to the Assignment of Easement include the Colorado Water Conservation Board, <br />Animas -La Plata Water Conservancy District (District), and Reclamation. <br />Article H.1. of the Assignment of Easement stipulates that Reclamation shall determine the exact <br />location and area of the perpetual easement for the DPP by December 31, 2008. As you know, <br />over the last few months we have been working with the District to determine the revised <br />perpetual easement area. The enclosed map, dated November 20, 2008, is the result of our <br />discus_ sions and provides an outline of the easement area that Reclamation plans to retain at this <br />time. Please provide your Board's concurrence regarding the general areas shown on the map in <br />order to accommodate Reclamation's future plans and operations. This is necessary to avoid re- <br />work and any resulting increased Project costs. Reclamation commits to inform the Board if <br />changes occur, although none are anticipated at this time. <br />Reclamation will not finalize its permanent easement area until construction for the entire Animas- <br />La Plata Project is complete, although not likely, there could be changes during construction that <br />may modify our easement requirements. Construction completion, including reservoir filling, is <br />currently scheduled for 2012. Shortly after that time, the final perpetual easement will be defined, <br />a survey will be completed and a plat map prepared. In addition, an Amendment to the <br />Assignment of Easement will be drafted for signature by all parties and recorded in La Plata <br />County. We anticipate finalizing the permanent easement within six months after construction is <br />complete. <br />
