Enclosed is a draft Contract and Grant of Easement along with the final legal xx- -�e
description and R -O -W Plat for Parcel No. DPP -1(P) for the Durango Pumping
Plant. Also enclosed is a District Court Rule anR. Order dated July 30, 1990
which awarded title of this parcel and other properties to the State of
Colorado. Please order title insurance and initiate other normal procedures
for acquisition of this property. We will be submitting the draft Contract and
Grant of Easement to the State of Colorado in February for acquisition of this
property as early as this summer.
Also enclosed is the February 2, 1990 Cost Sharing Agreement between the
United States and the State of Colorado which requires the State to provide
$5,600,000 to the United States for construction of the Animas -La Plata
Project. Article 8 of this agreement provides for the value of the Durango
Pumping Plant land to be credited against the $5,600,000 owed by the State.
Although the State Department of Health does not want the value of the land
specified in the Contract and Grant of Easement, they have stated they expect
Reclamation to credit the Colorado Water Conservation Board for "full market`'
value" of this land as provided in Article 8. Although the State paid $345,000
for this parcel and other properties, the fair market value of this parcel .
could be considerably more since surface contamination has since been removed.
In order to determine fair market value, please initiate an appraisal of Parcel
DPP -1(P).
