Description of PROJECT: The BORROWER applied to the CWCB for a loan to be used <br />for the construction of the Bergen Reservoir No. 2 Rehabilitation Project to make <br />improvements to the Bergen Reservoir No. 2 outlet works and dam, per the direction of <br />the Dam Safety Branch of the State Engineer's Office (SEO), located in Jefferson <br />County, hereinafter referred to as the PROJECT, at an estimated total cost of <br />$2,225,000. <br />B. Description of Feasibility Study: The CWCB has reviewed a feasibility study report on <br />the PROJECT entitled "Bergen Ditch and Reservoir Company Loan Feasibility Study," <br />dated August 2012, compiled by Robert Easton, Manager, Bergen Ditch and <br />Reservoir Company. Technical assistance was provided by James Ferentchak, P.E., <br />of W.W. Wheeler & Associates, Inc., and legal support was provided by Julia <br />Robinson, P.C. The study was prepared in accordance with CWCB guidelines and is <br />incorporated herein by reference. Two related studies were used in the preparation of <br />the W.W. Wheeler feasibility study: 1) "Dam Safety Review," dated March 2008, <br />prepared by BasePoint Design, which assessed, identified and provided <br />recommendations on several unsatisfactory items throughout the Bergen system and <br />specifically noted the importance of addressing the Bergen No. 2 dam; and 2) <br />"Geotechnical Engineering Study and Feasibility Level Design Proposed <br />Modifications to Bergen Dam No. 2," dated October 2011, prepared by Kumar and <br />Associates which provided specific design recommendations and preliminary design <br />drawings for various Bergen No. 2 dam modifications. <br />Based upon the feasibility report, the CWCB determined the PROJECT to be technically <br />and financially feasible. <br />SECTION 3 — CWCB'S AUTHORITY <br />Construction Fund: This loan is made pursuant to the provisions of §§ 37 -60 -119 and <br />37 -60 -120, C.R.S., which authorize the CWCB to loan money for water projects from <br />the CWCB Construction Fund for the benefit of the people of the state, provided that <br />the borrower assures repayment of that money. <br />Section 37- 60- 122(1)(b), C.R.S., authorizes the CWCB to make loans of up to <br />$10,000,000 from the CWCB's Construction Fund and the State Severance Tax Trust <br />Fund Perpetual Base Account Fund without prior approval from the General <br />Assembly. <br />Appendix 1 to Loan Contract C150344 <br />Page 1 of 4 <br />
