Law <br />Executive Director <br />Colorado Water Resources and <br />Power Development Authority <br />Suite 620 <br />1580 Logan Street <br />Denver, CO 80203 -1942 <br />MAY Z0W <br />Subject: Approval of Water Sales Agreements, Contract No. 02 -WC-40 -8000, Between the United <br />States and the Colorado Water Resources and Power Development Authority (Your Letter of <br />April 25, 2005), Animas -La Plata Project, Colorado <br />Dear Mr. Law: <br />Pursuant to Article 14 of Contract No. 02 -WC40 -8000, dated November 9, 2001, we have reviewed the <br />attached water sales agreements between the Colorado Water Resources and Power Development <br />Authority (Authority) and the following: <br />1. Agreement between the Authority and the Animas -La Plata Water Conservancy <br />District ( ALPWCD) for the purchase and sale of the right to 700 acre -feet of average <br />annual municipal and industrial (M &I) depletions from the ALPCD average annual <br />depletion allocation of 2,600 acre -feet. <br />2. Agreement between the Authority and the City of Durango, Colorado for the option to <br />purchase the right to 1,900 acre -feet of average annual municipal and industrial (M &I) <br />depletions from the ALPWCD average annual depletion allocation of 2,600 acre -feet. <br />The attached agreements have been reviewed by the Regional Solicitor for legal adequacy and approved <br />by this office on behalf of the United States.
