28. NOTICES <br />2 Any notice, demand, or request authorized or required by this contract shall be deemed to <br />3 have been given, on behalf of the State, when mailed, postage prepaid, or delivered to the <br />4 Regional Director, Upper Colorado Region, Bureau of Reclamation, 125 South State Street, <br />5 Room 6107, Salt Lake City, Utah 84138 -1102, and on behalf of the United States, when mailed, <br />6 postage prepaid, or delivered to the State of Colorado, Department of Natural Resources, <br />7 Colorado Water Conservation Board, 1313 Sherman Street, Room 721, Denver; CO 80203. The <br />8 designation of the addressee or the address may be changed by notice given in the same manner <br />9 as provided in this article for other notices. <br />10 <br />11 29. CONTINGENT ON APPROPRIATION OR ALLOTMENT OF FUNDS <br />12 The expenditure or advance of any money or the performance of any obligation of the United <br />13 States under this contract shall be contingent upon appropriation or allotment of funds. Absence <br />14 of federal appropriation or allotment of funds shall not relieve the State from any obligations <br />15 under this contract. No liability shall accrue to the United States in case funds are not <br />16 appropriated or allotted. <br />17 <br />18 30. OFFICIALS NOT TO BENEFIT <br />19 No Member of or Delegate to Congress, Resident Commissioner or official of the State shall <br />20 benefit from this contract other than as a water user in the same manner as other water users. <br />21 <br />22 31. CHANGES IN STATE'S ORGANIZATION <br />23 While this contract is in effect, no change may be made in the State's organization, by <br />24 inclusion or exclusion of lands or by any other changes which materially affect the respective <br />25 rights, obligations, privileges, and duties under this contract of either the United States or the <br />26 State including, but not limited toy dissolution, consolidation, or merger; except upon the <br />27 Contracting Officer's written consent, which shall not be reasonably withheld. <br />28 <br />29 32. ASSIGNMENT LIMITED— SUCCESSORS AND ASSIGNS OBLIGATED <br />30 The provisions of this contract shall apply to and bind the successors and assigns of the <br />31 parties hereto, but no assignment or transfer of this contract or any right or interest therein by <br />32 either party shall be valid until approved in writing by the other party. <br />33 <br />34 33. BOOKS, RECORDS, AND REPORTS <br />35 The State shall establish and maintain accounts and other books and records pertaining to <br />36 administration of the terms and conditions of this contract, including the State's financial <br />37 transactions; water supply data; project operation, maintenance, and replacement logs; project <br />38 land and rights -of -way use agreements; the water users' land -use (crop census), land- ownership, <br />39 land- leasing, and water -use data; and other matters that the Contracting Officer may require. <br />40 Reports shall be furnished to the Contracting Officer in such form and on such date or dates as <br />27 <br />
