12. STATE'S OBLIGATIONS FOR APPROPRIATIONS
sistent with Article 26 herein, the State intends to fulfill its obligations under this Contract.
State reasonably believes that funds in amount sufficient to fulfill these obligations lawfully
and will be available for this purpose. In the event funds are not appropriated in amounts
5 suf cient to fulfill these obligations, the State shall use its best efforts to satisfy any requirements
6 for ayments or contributions of funds under this contract from any other source of funds legally
7 ava lable for this purpose. Nothing herein shall constitute, nor be deemed to constitute, an
8 obligation of future appropriations by the General Assembly of the State of Colorado where
9 crelting such an obligation would be inconsistent with Colorado Revised Statutes or the

13. COVENANT AGAINST CONTINGENT FEES
Thi State warrants that it has not employed or retained any person or selling agency to solicit or
sec are this contract upon an agreement or understanding for a commission, percentage,
brc kerage or contingent fee, excepting bona fide employees or bona fide established commercial
or selling agencies maintained by the State for the purpose of securing business. For breach or
vic lation of this warranty, the United States shall have the right to annul this contract without
lia ility, or at its discretion, to add to the repayment obligation or consideration the full amount
of �uch commission, percentage, brokerage, or contingent fee.
14. THIRD -PARTY CONTRACTS
nsistent with applicable law, any contract entered into between the State and any third -party
the use of the State's Statutory Water Allocation under this Contract will be approved by the
