( The Project Operations Committee consisted of representatives from those entities that
were dentified by the Settlement Act, as amended, to receive a water allocation and the Bureau
of R lamation. This committee determined an appropriate entity to contract with Reclamation
fort operation, maintenance, and replacement (OM &R) of the Project Works and developed a
5 corm ion understanding among the project beneficiaries of the appropriate level of annual
6 OM &R activities to be performed on the Project Works to assure the Project's long term
7 oper, tional integrity and public safety. This committee was essentially replaced by the
8 Ass ( iation who subsequently entered into an OM &R contract with Reclamation. Ultimately,
9 the Association will oversee the ongoing OM &R activities of the Project Works, providing
10 con ltation and coordination among Association members on such items as annual OM &R
I 1 fun ing, maintenance schedules, and public safety issues.

13 4. MEASUREMENT AND RESPONSIBILITY FOR DISTRIBUTION OF STATUTORY
14 WATER ALLOCATION
15 a) The water released or bypassed for the State pursuant to this contract shall be measured
16 at t ie outlet works of Ridges Basin Dam, and /or in the Animas River at the Durango Pumping
17 Pla it with measuring facilities installed by the United States as a part of the Project. Additional
18 poi is of diversion directly from Lake Nighthorse may be made in the future by the State after
19 cot sultation and approval of the United States. Water delivered at these additional points of
20 di rsion on Lake Nighthorse shall be measured at those points of diversion by facilities
21 pr vided by the State or its subcontractors. Water will be available at the outlet works of Ridges
22 Basin Dam and /or the Animas River in such quantities as the State determines, subject to
23 cabacity limitations of the relevant facilities, to ensure that the State annually receives a
