STATE'S OBLIGATIONS FOR APPROPRIATIONS <br />Con istent with Article 26 herein, the State intends to fulfill its obligations under this Contract. <br />tate reas <br />The onably believes that funds in amount sufficient to fulfill these obligations lawfully <br />can nd will be available for this purpose. In the event funds are not appropriated in amounts <br />5 suffi ient to fulfill these obligations, the State shall use its best efforts to satisfy any requirements <br />6 for payments or contributions of funds under this contract from any other source of funds legally <br />7 availhble for this purpose. Nothing herein shall constitute, nor be deemed to constitute, an <br />8 obli ation of future appropriations by the General Assembly of the State of Colorado where <br />9 creajing such an obligation would be inconsistent with Colorado Revised Statutes or the <br />10 Col <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />Constitution. <br />13. COVENANT AGAINST CONTINGENT FEES <br />The State warrants that it has not employed or retained any person or selling agency to solicit or <br />secure this contract upon an agreement or understanding for a commission, percentage, <br />brob erage or contingent fee, excepting bona fide employees or bona fide established commercial <br />orselling agencies maintained by the State for the purpose of securing business. Forbreach or <br />viol ition of this warranty, the United States shall have the right to annul this contract without <br />18 liability, or at its discretion, to add to the repayment obligation or consideration the full amount <br />19 of sj <br />20 <br />21 <br />22 Con <br />23 for <br />commission, percentage, brokerage, or contingent fee. <br />14. THIRD -PARTY CONTRACTS <br />sistent with applicable law, any contract entered into between the State and any third -party <br />he use of the State's Statutory Water Allocation under this Contract will be approved by the <br />22 <br />
